Guidelines for Manufacturing License in India

We have laid down some of the guidelines for the manufacturing license certificate holder from
the Department of Legal Metrology. The guidelines are taken from Section 23 of India’s Legal
Metrology Act of 2009. Let us look at them one by one.

Manufacturing License Mandation

The Authority allows no person to manufacture, expose, or possess any weight or measuring
instrument for repair or sale unless he holds a valid LM license issued by the Department
Controller. However, the manufacturer license holder requires no additional license to repair his
weight or measure in a State other than the manufacturing state of the equipment.

Issue of Manufacturing License

As per sub-section (1) of the Legal Metrology Act of India 2009, the Controller can issue a
manufacturing license in a form and manner as prescribed on certain conditions, periods, and
areas of jurisdiction. The applicant must also pay the licensing fee as prescribed by the
Controller to get the manufacturing license from him.

Application Filing and Form Filling

Every manufacturing certificate holder of weight or measure must apply for the compulsory
license issued to the Controller of the Legal Metrology Department or other Officer authorized
by the Controller on this behalf. The application must be in the appropriate form in Schedule II-
A of the Legal Metrology Act.

Repair License for the Manufacturer

However, the Authority does not mandate the Manufacturer to have a license to repair weight or
measure manufactured by him and used in a state other than the manufacturing state of the
equipment. But the Manufacturer must inform the concerned Legal Metrology executive about
the equipment repair in advance.

Trading License for Non-Tribal Manufacturers

Non-tribal manufacturers who operate the business in the Sixth Scheduled Areas of Meghalaya
and other states of the North East must obtain the requisite Trading License from the respective
ADCs (Autonomous District Councils) of the State of North-eastern region of India.
